Tax information for sellers (DAC7)

This page is for those who sell on Secondaro. It is short and says exactly what the law requires us to do with your tax details. We are not tax advisers: for your situation, ask an accountant.
1. What DAC7 is
DAC7 is Directive (EU) 2021/514, applied in Romania through the Fiscal Code. It requires online platforms like Secondaro to report once a year to ANAF (the Romanian tax authority) the sellers who exceed certain thresholds. ANAF passes the data on to the tax authority of your country, if it is not Romania. The purpose: that income from online sales is taxed where the law requires.
2. When we report
We report a seller if, in one calendar year, on Secondaro they had 30 or more sales or received 2,000 euro or more (in lei, at the year's exchange rate) [DE VERIFICAT JURIDIC: pragurile exacte și modul de calcul al echivalentului în lei]. Below both thresholds we report nothing about you.
The report is sent by 31 January of the following year, for the year that ended. We also send you a copy of the data reported, so you know exactly what went out.
3. What we report
- First and last name (or the business name), address, country of tax residence.
- Tax number: CNP for Romania, TIN for other countries; for businesses the tax identification number and the Trade Register number.
- Date of birth (for private individuals).
- The IBAN where you receive the money and the account holder's name.
- The number of sales and the total amount received, per quarter.
- The fees and charges withheld by the platform.
4. What data we ask for and when
The law requires us to collect identification details from every seller who receives money, not only from those above the thresholds, so that we can count. That is why, at your first listing or your first withdrawal, we ask for: your legal name (from your ID), tax number, country of tax residence, date of birth and address. The IBAN you give to the payment provider (Stripe), when opening the payment account.
The data is stored encrypted and shown masked (for example ****1144). We keep it for as long as the law requires, at least 5 years from the reporting year, including after the account is deleted [DE VERIFICAT JURIDIC: termenul de păstrare a evidențelor DAC7]. We do not use it for anything else.
If you do not give us the data after two requests, the law requires us to stop payouts to you or to close your seller account until we receive it.
5. What it means for your taxes
If you occasionally sell personal things you have used (clothes, footwear, books, things from the house), this income is usually not taxable in Romania (Fiscal Code, Article 62, letter m) [DE VERIFICAT JURIDIC: încadrarea și excepțiile]. DAC7 reporting does not automatically mean tax: it only means ANAF knows about the sales.
If you sell frequently, buy specifically to resell, sell new products in series or run a shop, your activity may be considered commercial and taxable, and on the platform you must have a Pro account, with the business details on the listing. For expensive items keep the proof of purchase, in case ANAF asks.
If you live in another European Union country, your own country's tax rules apply; the data reaches your tax authority through ANAF.
