This page explains how Secondaro works and what we promise each other. We wrote it in plain words so you can read all of it in a few minutes. If something is unclear, write to us.
When you create an account, you tick that you have read these terms and agree with them. They are the contract between you and us. Buying and selling happens between users; there we are the intermediary, as explained below.
1. Who we are
The Secondaro platform, at seconda.ro, is built and run by Monea Software [FORMA JURIDICA], tax identification number [CUI], registered with the Trade Register under number [NR. REG. COM.], with its registered office at [ADRESA], Romania. Email: [EMAIL]. In this text we call ourselves "Secondaro", "the platform" or "we".
These details are the ones required by Romanian Law 365/2002 on electronic commerce. They also appear in the footer of every page.
2. What Secondaro is and what it is not
Secondaro is an online marketplace where people and businesses sell things they have used or no longer need: clothes, electronics, books, things for the home and for children, sports, collectibles, parts and tools. It works in all 24 official languages of the European Union, and messages between users are translated automatically.
What we do: we host the listings, we connect the buyer with the seller, we collect the payment and hold it until the buyer confirms the parcel has arrived, we provide the shipping label, we translate messages, we settle problems and we moderate the platform.
What we do not do: we are not a party to the sale. The sales contract is between the buyer and the seller. We do not own, physically inspect or ship the items. We are not responsible for their quality or condition beyond the Buyer Protection described below. We are not a payment institution: payments are processed by Stripe, a payment provider licensed in the European Union.
The platform is for selling physical goods. Services, rentals, real estate, jobs and whole vehicles are not sold here.
3. Your account
- You must be at least 18 to create an account. We ask for your date of birth when you sign up.
- One person, one account. You do not create another account to get around a suspension or a limit.
- The details in your account must be true: your name, email address, delivery address. The name shown can be a nickname, but the legal name required for payments and tax obligations must be the one on your ID.
- Your password has at least 10 characters and is yours. You do not share it. If you think someone else has got into your account, change the password and write to us.
- You are responsible for everything done from your account until you tell us it was used without your consent.
When you sign up we send a 6-digit code to your email so you can confirm the address. You can sell and buy once the address is confirmed. A login session lasts 30 days; you can see the devices logged in and remove them from Settings.
You can delete your account at any time from Settings. Details in the Privacy policy. While you have orders in progress, deletion waits until they are closed.
4. Private sellers and Pro sellers
On every listing we say whether the seller is a private individual or Pro (a trader). The law (Directive 2019/2161, the "Omnibus" directive, transposed in Romania by Law 148/2023 [DE VERIFICAT JURIDIC: numărul legii de transpunere]) requires us to tell you, because your rights differ:

The seller declares what kind of seller they are. If you sell new products in series, buy in order to resell, or run a shop, you are a trader and must switch your account to Pro and fill in your business details. A private account used for trading can be switched to Pro by us or suspended.
For Pro sellers we show on the listing: the business name, tax identification number, Trade Register number, address and a means of contact, plus the declaration that they sell only products that comply with the law. This is the information required by Regulation (EU) 2022/2065 (DSA), Article 30.
5. The listing: what you can sell and what is forbidden
The basic rule: you sell things you have. One listing, one item (or one set sold together). Photos taken by you, of your item, as it looks now. Defects are written in the description and shown in the photos. The price is between 1 and 100,000 lei. The full rules, with the 9 category branches and the list of forbidden items, are in the Catalogue rules.
In short, it is forbidden to sell: weapons and dangerous objects; medicines and medical products; tobacco, e-cigarettes and nicotine products; drugs, including CBD products; live animals and plants, products from protected species; counterfeits and items with fake brands; tickets, vouchers, gift cards, codes and virtual currency; opened cosmetics and hygiene products, worn underwear; recalled products or products without CE marking; stolen goods or goods of unclear origin, locked phones or phones with active accounts; adult content; hate symbols; documents, official uniforms and insignia; food and drink; services, rentals, real estate and whole vehicles; classified heritage objects, fossils and remains.
You do not upload photos of other recognisable people without their consent, photos taken from the internet, from adverts or with watermarks, and you do not edit photos to hide defects.
A listing that breaks the rules is removed. On repetition, the account is closed. How we make decisions and how you can appeal is described under Moderation.
Publishing is free. We charge no listing fees. When we sell paid options (for example promoting a listing), the price is shown before you pay and is never compulsory.
6. Buying: price, protection fee, shipping
When you buy, you pay three things, shown separately before payment:
- The item price, set by the seller (or the price agreed through an accepted offer).
- The buyer protection fee: 5% of the item price plus 3.50 lei (or the equivalent in the listing currency). It pays for keeping the money safe, settling problems, refunds and running the platform. The fee may change over time or by listing currency; you always see it before you pay and it does not change after you have paid.
- Shipping, at the price of the courier you choose among those available for the listing.
Payment is by card, through Stripe. We do not see or store your card number. When you pay, the item is reserved for you; if the payment is not completed within 30 minutes, the reservation lapses and the item goes back on sale.
You can only buy through the platform. An arrangement outside it (paying the seller directly, cash on delivery) is not covered by Buyer Protection and breaks these terms.
Listing prices are final for the buyer. Pro sellers are responsible for including VAT and any other tax the law requires in their price.
7. Buyer Protection
On every order paid through the platform, the money stays with the platform until you confirm you have received the parcel. The seller gets it only after that.
The 2 days after delivery
When the courier marks the parcel as delivered, you have 2 days to choose one of two: "All good" or "I have a problem". If you choose nothing within 2 days, the order is confirmed automatically and the money goes to the seller. Open the parcel as soon as you can and check it.
What protection covers
- The parcel did not arrive (marked delivered but not received, or lost on the way).
- The item does not match the description or photos: a different item, size or model, defects not mentioned, missing pieces from a set.
- The item arrived damaged because of shipping or packaging.
- The item is counterfeit.
What it does not cover
- "I do not like it" or "I changed my mind". Between private individuals there is no right to return without a reason. From a Pro seller you have the 14-day right of withdrawal described under Private sellers and Pro sellers.
- Small differences, normal for a used item, that were visible in the photos or written in the description.
- Damage that appeared after you received the parcel.
- Orders made outside the platform.
How you open a problem
From the order page, within the 2 days, you press "I have a problem", choose the reason and add photos of the item, the packaging and the defect. The money stays on hold. The seller has 3 days to respond: they can accept the refund, propose a partial refund (you keep the item and get part of the money back) or contest. If you cannot agree or the seller does not respond within 3 days, the problem comes to us and we decide within 48 hours of receiving it, based on the evidence from both sides. Our decision is explained in writing and can be appealed once, within 7 days.
The return
If the problem is confirmed and the item reached you, you send it back with the return label we give you, within 5 working days of the decision, packed as you received it. The seller pays the return shipping when the item does not match the description; the amount is deducted from their money. You do not return an item confirmed as counterfeit; you get your money back and we report it. With a partial refund there is no return: you keep the item.
The refund
With a full refund you get back everything you paid: the item price, the protection fee and the shipping. The refund is sent when the seller confirms they have received the return or, if they do not confirm, 2 days after the return is marked delivered. When no return is needed (parcel not arrived, counterfeit, seller accepted), it is sent at once. The money goes back to the card you paid with, usually within 5-10 working days, depending on your bank.
If the seller does not ship within 5 working days of payment, the order is cancelled automatically and you get all your money back. If the parcel is shipped but does not arrive within 20 days, it is declared lost and you get all your money back; we handle the claim with the courier.
8. For sellers: shipping, money, payment account
Shipping
- You ship within 5 working days of payment (working days in Romania; public holidays do not count). Otherwise the order is cancelled, the buyer gets their money back and the item goes back on sale. If you cannot ship, cancel the order yourself as soon as possible.
- You use the shipping label provided by the platform, through the integrated couriers. It is compulsory: through it we track the parcel, and Buyer Protection and the compensation for loss rely on it. A parcel sent any other way is not covered.
- You pack properly. Damage caused by poor packaging is your responsibility.
- You send exactly what is in the listing, clean, with everything you said was included.
When you get the money
After the buyer confirms receipt (or 2 days after delivery, if they do not open a problem), the item price is transferred to your payment account. The first payout is made after the payment account is verified. The money reaches your bank account according to the payment provider's schedule, usually within a few working days. The protection fee and the shipping are not yours: the buyer pays them to the platform and to the courier.
The payment account and identity verification
To receive money, we open a payment account for you at Stripe, our payment provider. Stripe asks for your legal name, date of birth, address, an identity document and a bank account (IBAN). This is required by anti-money-laundering law, and the verification is done by Stripe, not by us: we only receive the confirmation that you are verified. Without verification, the money from your sales waits and is released once you complete it.
Problems and returns
When a buyer opens a problem, you respond within 3 days: you accept the refund, propose a partial refund or contest with evidence. If you do not respond, we decide. When the problem is confirmed, you pay the return shipping (deducted from your money) and get the item back. When the problem is rejected, you get the money as for a normal order.
Holiday mode and listings
You can put your account in holiday mode from Settings: your listings no longer appear in search until you are back. An item reserved for a buyer stays reserved for 5 days; after that it becomes active again by itself.
9. Offers and bundles
- The buyer can make a price offer on an active item. The offer is at least 60% of the asking price and at most the asking price. There are at most 25 offers per 24 hours per account.
- An offer expires in 24 hours. The seller can accept it, decline it or make a counter-offer. In a conversation there is at most one open offer.
- An accepted offer is valid for 24 hours: during this time the buyer can buy at the agreed price. After that the price goes back to the listing price.
- A bundle is a set of 2 to 100 items from the same seller, bought together, with a single shipment. The seller can set bundle discounts, in steps, from Settings. The discount is shown before payment.
An accepted offer is not an order. The order exists when the buyer pays. Until then the item stays on sale for everyone.
10. Reviews
After the money is released, the buyer and the seller can each leave a review, within 30 days. The review is about the real transaction: how the item was, the packaging, the communication, the payment.
Fake, bought or exchanged reviews, offensive reviews, reviews with personal data or about other transactions are not allowed. We remove reviews that break the rules and explain why, as with any moderation decision. The review stays with the transaction after an account is deleted, without a name.
11. Messages and automatic translation
You can write to the seller or the buyer from the item page. Messages written in another language are translated automatically into yours; you can always see the original text. Automatic translation can be wrong; for anything unclear about the item or the agreement, the original text is what counts.
Messages are for the transaction. Not allowed: harassment, insults, threats, spam, advertising, proposing to pay outside the platform, asking for personal data that is not needed (identity document, card), sending misleading links. You can block a user; blocking stops messages, offers and bundles between you.
Messages are not end-to-end encrypted: we can read them when one of you reports a problem to us or when the law requires it. We do not read them otherwise.
12. Rules of conduct
- You are honest: in the listing, in messages, in reviews, when opening a problem. False problems and doctored evidence are a serious breach.
- You do not pretend to be someone else and do not use another person's name, photo or brand.
- You do not manipulate the platform: no multiple accounts, automated programs, fake purchases, artificially raising prices or reviews.
- You do not bypass the fees: no payments outside the platform for items listed here.
- You respect the law of your country and of the buyer's country, including when exporting certain goods (batteries, restricted products).
13. Moderation: reports, decisions, appeals
Regulation (EU) 2022/2065 (DSA) requires us to say how we moderate. Here is how.
How you report
On every listing, profile, message and review there is "Report". You choose the reason (illegal content, counterfeit, forbidden item, scam, harassment, personal data, other), write briefly why and, if you want, add evidence. You can leave your email address to receive the answer. Reports also come by email, including from authorities and from organisations that defend rights. Repeated, groundless reports made to harass someone are a breach too.
What we do
We read every report and decide as quickly as we can, usually within 2 working days. For clearly illegal or dangerous content we act at once. An automated program checks photos on upload (adult content, violence) and the form of the listing (fields, price, photos); decisions about content are made by a person. Whoever reported gets an answer with what we decided.
What measures we can take
- Removing or hiding a listing, a photo, a message or a review.
- Asking you to correct the listing within a given time.
- A warning.
- Limiting some features (messages, offers, publishing) for a while.
- Suspending the account for a while or closing it, for serious or repeated breaches. Orders in progress are completed or refunded.
- Informing the authorities when we see signs of a crime (stolen goods, counterfeiting at scale, danger to life).
The reasons for the decision
When we take a measure against your account or your content, we send you in writing (in your account and by email): what we did, on which content, which rule in these terms or in the law we relied on, whether the decision came from a report or from our own check, whether an automated means was used, and how you can appeal. We do not say who reported.
The appeal
You can appeal any decision, once, within 14 days, from your account or by email. It is read by a different person from the one who decided first. We answer within 7 days at most. If we were wrong, we put things right and say so. If you are still not satisfied, you can go to court or, as a consumer, use the mechanisms under Applicable law and dispute resolution. The authority supervising the application of the DSA in Romania is ANCOM.
The point of contact
The single point of contact for users and for authorities (DSA, Articles 11 and 12) is [EMAIL], in Romanian and in English. Details on the contact page. Once a year we publish a short report with the number of reports received and the measures taken.
14. Tax reporting (DAC7)
The law (Directive (EU) 2021/514, "DAC7", applied in Romania through the Fiscal Code) requires us to report every year to ANAF, the Romanian tax authority, the sellers who in one year had at least 30 sales or received at least 2,000 euro. We report: name, address, tax number (CNP or TIN), date of birth, IBAN, number of sales and amounts received, fees withheld. Below these thresholds we report nothing, but the law requires us to collect identification details from every seller who receives money.
That is why, at your first listing or your first withdrawal, we ask for your tax details. We keep them encrypted and for as long as the law requires, including after the account is deleted. What this means for your taxes is on the DAC7 information page. We are not tax advisers: for your situation, ask an accountant.
15. Your content and ours
What you upload (photos, texts, reviews, messages) remains yours. You give us a free, non-exclusive, worldwide licence to show it on the platform, resize it, translate it automatically and use it in search and category pages, for as long as the listing or the account exists. You guarantee that you have the right to upload it and that it does not infringe anyone else's rights.
The platform, the name "Secondaro", the logo, the design, our texts, the category taxonomy and the code belong to Monea Software. You do not copy them, extract them automatically or use them for another service without our written consent.
16. Liability
We build the platform with care, but we provide it "as is". We do not promise that it is available without interruption or without errors. We can stop or change features for maintenance, safety or because we decide to change them.
We are not liable for: the conduct of users, the truth of listings, the quality of items, courier delays, indirect losses (lost profit, lost time). What we are liable for towards the buyer is described under Buyer Protection, and towards the seller in the compensation for a parcel lost with our label.
If you are a consumer, the rights the law gives you remain whole, whatever is written here. Nothing in these terms limits our liability for damage caused intentionally or through gross negligence, or for injury to health.
You are liable towards us and towards the other users for damage caused by breaking these terms or the law, including the costs of a groundless dispute with your bank (chargeback).
17. Suspension and termination
You can close your account at any time from Settings, if you have no orders in progress. We can suspend or close your account for serious or repeated breaches, for fraud, at the request of an authority or if the law requires it. We tell you why, as with any moderation decision, except where telling you would hinder an investigation or put someone in danger.
On closure, paid orders are completed or refunded, money owed to you is paid after the orders are closed, and your data is handled as described in the Privacy policy.
We can stop the platform or part of it with 30 days' notice, except in cases of force majeure or legal obligation. Orders in progress are completed.
18. Changes to the terms
When we change something important, we tell you in your account and by email at least 15 days in advance, with what changes and why. If you do not agree, you can close your account before the change takes effect; orders in progress stay on the old terms. Continuing to use the platform after the change date means acceptance. Small corrections (typos, clarifications) are made without notice, by changing the date at the top.
19. Applicable law and dispute resolution
Romanian law applies. If you are a consumer in another European Union country, you keep the protection your own country's law gives you where it is more favourable.
Disputes are first settled by talking: write to us and we answer within 2 working days. If that is not possible, the courts of Romania have jurisdiction, without affecting a consumer's right to go to the court of their own domicile.
As a consumer you can also turn to: the Romanian National Authority for Consumer Protection (ANPC), the Alternative Dispute Resolution (ADR, "SAL") procedure at anpc.ro/ce-este-sal, and the European Online Dispute Resolution (ODR, "SOL") platform at ec.europa.eu/consumers/odr [DE VERIFICAT JURIDIC: platforma SOL a fost închisă în 2025 (Regulamentul (UE) 2024/3228); adresa trimite acum la o pagină de mutare; de hotărât dacă legătura rămâne în subsol și în text]. These routes concern the relationship between you and the platform or between you and a Pro seller; between two private individuals consumer law does not apply.
